Man run over by portland police could get $45,000 payout

A man who was run over by a portland police patrol car in 2012 and subsequently injured, is about to cash in. The city is prepared to pay Jimmy Miles Duffy $45,000.

Oregon Live reports:

The proposed payment, on the Portland City Council’s consent agenda Wednesday, would settle Jimmy Miles Duffey’s notice of intent to sue the city for personal injuries, and future economic and non-economic damages.

Police said two officers spotted Duffey jaywalking about 8:40 p.m. on Nov. 19, 2012 near Southwest 12th Avenue and Columbia Street, and went to talk to him. The man ran but was caught by an officer at Southwest Main and Park Street, police said.

A responding officer exited the patrol car but left it the vehicle in drive. The car then rolled onto Duffy, who was handcuffed and lying on his back, according to his attorney.
Duffy sustained injuries to his head, hip and arm. He also reported pain in his neck and numbness in an arm after the incident.

The city’s risk management bureau found “there is risk the city may be found liable,” and recommended the city settle the claim.

The final decision on the settlement will be made today.
